BATESVILLE —

Due to an unintentional violation of Indiana's Open Door Law – notification of a meeting was sent by fax from the mayor's office toThe Herald-Tribune, but never received – a vote at the Nov. 1 Batesville Economic Development Commission meeting was invalid.

Referring to public agencies, Indiana Code 5-14-1.5-5 states, "Public notice of the date, time and place of any meetings, executive sessions or of any rescheduled or reconvened meeting shall be given at least 48 hours (excluding Saturdays, Sundays and legal holidays) before the meeting." The governing body must give notice by either mail, e-mail or fax, according to the code.

BEDC President Andy Saner announced Nov. 6, "The EDC is holding a second meeting (Saturday, Nov. 9, at 9 a.m. in the Memorial Building first floor conference room) to take a vote on a development partner that can assist us in finalizing financing, budget, design and location options for a proposed shell building project.

"A brief review of the developers interviewed for this project by EDC will be provided, but the primary purpose of this meeting is to take an official vote by the EDC members on which developer we would like to work with on this next phase of the process."
